PETANDHOUSEEU — TERMS & CONDITIONS

These Terms & Conditions ("Terms") govern access to and use of the PetAndHouseEU website, mobile application and related services (collectively, the "Platform").

By creating an account, purchasing a membership or using the Platform, you agree to these Terms.

1. THE ROLE OF PETANDHOUSEEU

1.1. Intermediary Platform

PetAndHouseEU is an online platform providing information society and digital services.

The purpose of the Platform is to provide an interface through which registered pet and house owners ("House Owners" or "Owners"or "Pet Parents") and pet and house sitters ("Sitters") can discover, communicate with and connect with each other.

1.2. PetAndHouseEU Is Not a Party to Sitting Arrangements

PetAndHouseEU provides the technological platform through which Members can find and communicate with each other.

Unless expressly stated otherwise, PetAndHouseEU is not a party to private sitting arrangements concluded between Members.

PetAndHouseEU does not employ Sitters and does not act as an employer, employment agency, agent, contractor or representative of either Member.

Members are responsible for discussing and agreeing between themselves the details of each sitting, including dates, pet-care requirements, house rules, access arrangements and other relevant conditions.

1.3. Member Information and Verification

Members are responsible for ensuring that information they provide through the Platform is truthful, accurate and up to date.

Unless PetAndHouseEU expressly states that a particular verification has been performed, PetAndHouseEU does not independently guarantee the identity, background, suitability, reliability or accuracy of information provided by Members.

Members should exercise appropriate care and judgment when communicating with other Members and before entering into a sitting arrangement.

2. NON-MONETARY NATURE OF SITTINGS

2.1. Non-Monetary Exchange

Sitting arrangements facilitated through PetAndHouseEU are intended to operate as non-monetary private arrangements between Members.

2.2. Core Concept

The basic arrangement is that the Sitter receives accommodation at the House Owner's property without paying an accommodation fee for the agreed sitting period.

In exchange, the Sitter provides the agreed house supervision and pet-care activities.

2.3. No Sitting Fee or Salary

Members must not use the Platform to request, offer or arrange salaries, hourly wages, professional sitting fees or other monetary compensation in exchange for the sitting itself.

Reasonable expenses that may arise during a sitting, including authorised veterinary expenses, are not considered payment for sitting services.

2.4. No Employment Relationship

Use of the Platform does not by itself create an employment relationship, agency relationship or independent contractor relationship between PetAndHouseEU and a Member.

PetAndHouseEU does not employ Sitters and does not determine their working hours, wages or employment conditions.

Members are responsible for ensuring that their individual arrangements comply with any laws applicable to them.

Deliberately using the Platform to arrange prohibited paid sitting services may result in suspension or termination of the Member's account.

3. MEMBERSHIP REQUIREMENTS AND USER OBLIGATIONS

3.1. Minimum Age

Members must be at least 18 years old and legally capable of entering into a contract to create an account, purchase a membership or arrange a sitting through the Platform.

3.2. Account Information

Members must provide accurate information and keep their account details reasonably up to date.

Members are responsible for maintaining the confidentiality and security of their login credentials.

3.3. Communication

Members should respond to genuine direct inquiries and messages from other Members within a reasonable period.

PetAndHouseEU encourages Members to respond within 72 hours where reasonably possible.

3.4. Misuse of the Platform

Members must not:

  • use the Platform for fraudulent, unlawful or misleading purposes;

  • impersonate another person;

  • deliberately provide materially false information;

  • interfere with the security or operation of the Platform;

  • scrape, copy or systematically extract Platform data without permission;

  • use Member information obtained through the Platform to create or operate a competing database or service;

  • send spam or unsolicited commercial communications to Members; or

  • use the Platform to arrange activities prohibited by these Terms.

PetAndHouseEU may take proportionate action against accounts that materially or repeatedly breach these Terms.

4. OBLIGATIONS OF HOUSE OWNERS

4.1. Accurate Information

House Owners must provide Sitters with accurate and reasonably complete information concerning the property, pets and material requirements of the sitting.

4.2. Pet Health and Behaviour

House Owners are responsible for disclosing known medical conditions, behavioural issues, special care requirements and any material safety risks associated with their pets.

House Owners must comply with applicable laws concerning the ownership, keeping and vaccination of their animals.

4.3. Emergency Veterinary Care

House Owners should provide appropriate veterinary contact information and emergency instructions before the sitting begins.

Where urgent veterinary treatment is reasonably necessary and the House Owner cannot be contacted, the Sitter may seek appropriate veterinary assistance.

The House Owner must reimburse reasonable and verifiable emergency veterinary expenses properly incurred by the Sitter on behalf of the Owner's pet, unless otherwise required by applicable law or agreed between the Members.

4.4. Cameras and Surveillance

House Owners must disclose surveillance equipment located at or around the property before the sitting begins.

Cameras, audio recording equipment or other monitoring devices must not be used in private living, sleeping or bathroom areas occupied by the Sitter during the sitting.

Any surveillance must comply with applicable privacy and data-protection laws.

4.5. Weapons and Dangerous Items

Where weapons or other potentially dangerous items are legally kept at the property, the House Owner is responsible for ensuring that they are lawfully and securely stored and inaccessible to the Sitter and unauthorised persons.

5. OBLIGATIONS OF SITTERS

5.1. Duty of Care

Sitters must exercise reasonable care when looking after the House Owner's property and pets and should follow reasonable instructions provided by the House Owner.

5.2. Agreed Sitting Period

A Sitter who has accepted a sitting should not abandon the property or pets before the agreed completion of the sitting without reasonable justification.

Where an emergency, force majeure event or other serious circumstance makes continuation impossible, the Sitter should notify the House Owner as soon as reasonably possible so alternative arrangements can be made.

5.3. Serious Breaches

Unauthorised abandonment of pets or a property, deliberate mistreatment of animals, theft, fraud, serious property damage or other serious misconduct may result in immediate suspension or permanent termination of the Member's account.

Any account action will be subject to applicable mandatory law.

5.4. Overnight Arrangements

Where staying overnight at the property forms part of the agreed sitting arrangement, the Sitter should comply with that arrangement.

Pets must not be removed from the property for overnight stays elsewhere without the House Owner's permission, except where reasonably necessary for the animal's safety or emergency care.

6. VIDEO INTRODUCTIONS

6.1. Availability

Sitter Members and Members with a Both Membership may upload a short video introduction of up to 15 seconds to their profile.

The video introduction forms part of the Member's profile and may be displayed to other users of the Platform in accordance with the Platform's functionality and applicable privacy settings.

6.2. Responsibility for Uploaded Videos

Members are responsible for the content of videos they upload.

Members must ensure that they have all necessary rights, permissions and consents to upload and display the video and any content or persons appearing in it.

6.3. Prohibited Video Content

Video introductions must not contain:

  • unlawful content;

  • threatening, abusive or discriminatory content;

  • sexually explicit or pornographic content;

  • deliberately misleading or fraudulent content;

  • content infringing another person's intellectual-property rights;

  • content violating another person's privacy or image rights;

  • passwords, payment-card information or other information that could create an unreasonable security risk; or

  • other content that materially violates these Terms or applicable law.

6.4. Third Parties in Videos

Members should avoid including other identifiable persons in their introduction video unless they have the necessary permission to do so.

Members are responsible for obtaining any legally required consent concerning another person appearing or being heard in their video.

6.5. Moderation

PetAndHouseEU may remove, restrict or disable access to a video where reasonably necessary because the content violates these Terms, applicable law, another person's rights or Platform safety requirements.

6.6. Personal Data

Video introductions may contain personal data including a Member's image, voice and other information voluntarily disclosed in the video.

The collection, storage, display and other processing of personal data contained in video introductions is further described in the PetAndHouseEU Privacy Policy.

7. MEMBERSHIP, PRICING, AUTOMATIC RENEWAL AND REFUNDS

7.1. Annual Membership Plans

PetAndHouseEU offers the following annual membership tiers:

Sitter Membership: €69 per year

Pet Parent Membership: €89 per year

Both Membership (Sitter + Pet Parent): €99 per year

Applicable taxes, including VAT where required, will be handled in accordance with applicable law and displayed where required before purchase.

7.2. Automatic Renewal

PetAndHouseEU memberships are annual subscriptions.

Unless cancelled before the applicable renewal date, the subscription automatically renews for another one-year period and the applicable annual membership fee will be charged to the registered payment method.

The renewal terms and applicable price will be presented to the Member in accordance with applicable consumer-protection requirements.

7.3. Cancellation

Members may cancel automatic renewal through the available account settings or by contacting PetAndHouseEU.

Cancellation prevents the subscription from renewing for the following annual period.

Cancellation does not normally terminate the already paid membership immediately.

The Member may continue using the features included in the purchased membership until the end of the current paid annual subscription period.

After that date, the membership will not renew and no membership fee will be charged for the next annual period.

7.4. No Pro-Rata Refund Following Ordinary Cancellation

Except where a refund is required by applicable mandatory law, cancellation during an already paid annual subscription period does not entitle the Member to a full or partial refund for the unused remainder of that subscription period.

For example, if a Member cancels four months after purchasing an annual membership, the Member may continue using the membership until the end of the paid year, but the unused months are not refunded solely because the Member decided to cancel.

7.5. EU/EEA Consumer Right of Withdrawal

Where applicable, consumers residing in the European Union or European Economic Area have a statutory right to withdraw from a distance contract within fourteen (14) days from conclusion of the contract without giving a reason, subject to applicable consumer-protection law.

Where a consumer expressly requests that provision of the PetAndHouseEU service begins during the withdrawal period, access may begin immediately.

Where permitted by applicable law, if the consumer subsequently exercises a valid right of withdrawal after expressly requesting that performance begin during the withdrawal period, the consumer may be required to pay an amount proportionate to the service supplied up to the time PetAndHouseEU is informed of the withdrawal.

PetAndHouseEU will process any legally required reimbursement in accordance with applicable law.

Nothing in these Terms limits any statutory withdrawal right that cannot lawfully be excluded or restricted.

7.6. Refund Policy After the Statutory Withdrawal Period

After expiry of any applicable statutory withdrawal period, membership fees are not refundable solely because a Member:

  • no longer wishes to use PetAndHouseEU;

  • changes their mind;

  • changes travel plans or personal circumstances;

  • does not use or only partially uses the Platform;

  • does not find a suitable Sitter;

  • does not find a suitable House Owner;

  • does not find a suitable property or sitting opportunity;

  • does not receive applications or responses from other Members;

  • does not successfully arrange a sitting; or

  • cancels automatic renewal before the end of the paid annual period.

PetAndHouseEU provides a platform for Members to discover and communicate with each other.

PetAndHouseEU does not guarantee that a Member will find a suitable Sitter, Owner, property or sitting opportunity or successfully conclude a sitting arrangement.

This clause does not affect refunds, price reductions, termination rights or other remedies required by applicable mandatory consumer-protection law.

8. PAYMENTS

Membership fees must be paid using the payment methods made available through the Platform.

Members are responsible for ensuring that their payment information is valid and that they are authorised to use the selected payment method.

PetAndHouseEU may use third-party payment processors to process membership payments.

PetAndHouseEU does not guarantee that every payment method will be available in every country.

9. MEMBER CONTENT

Members may upload or provide content including profile information, photographs, introduction videos, listing information, reviews and messages ("Member Content").

Members retain ownership of their Member Content.

By uploading Member Content to the Platform, the Member grants PetAndHouseEU a non-exclusive licence to host, store, reproduce, display and technically process that content to the extent reasonably necessary to operate and provide the Platform.

Members must have the necessary rights and permissions for content they upload.

PetAndHouseEU may remove or restrict content that violates these Terms, applicable law or the rights of another person.

10. REVIEWS AND COMMUNITY INFORMATION

Reviews should reflect genuine experiences and must not knowingly contain false, defamatory, threatening or unlawful material.

PetAndHouseEU may moderate or remove reviews where reasonably necessary to enforce these Terms or comply with applicable law.

PetAndHouseEU does not guarantee the accuracy of Member reviews.

11. ACCOUNT SUSPENSION AND TERMINATION

PetAndHouseEU may suspend, restrict or terminate an account where reasonably justified, including in cases of:

  • fraud or attempted fraud;

  • serious or repeated breaches of these Terms;

  • threats to Member or animal safety;

  • misuse of the Platform;

  • illegal activity;

  • deliberate misrepresentation;

  • harassment or abusive behaviour;

  • serious animal welfare concerns; or

  • material security risks.

Where appropriate and required by applicable law, PetAndHouseEU will provide the Member with information concerning the reason for the restriction or termination.

Termination resulting from a Member's serious breach does not automatically create a right to a refund, except where mandatory law requires otherwise.

12. PLATFORM AVAILABILITY AND CHANGES

PetAndHouseEU aims to maintain a reliable Platform but does not guarantee uninterrupted or error-free availability.

Temporary interruptions may occur due to maintenance, security measures, technical failures or circumstances outside PetAndHouseEU's reasonable control.

PetAndHouseEU may update or modify Platform features where reasonably necessary.

Where changes materially affect a paid digital service, Members will have any rights and remedies provided by applicable mandatory law.

13. DIGITAL SERVICE CONFORMITY AND MANDATORY CONSUMER RIGHTS

Where EU or national consumer-protection law concerning digital services applies, PetAndHouseEU will provide the digital service in conformity with applicable contractual and legal requirements.

Where the digital service is not supplied or does not conform to the contract, consumers may have statutory remedies including having the service brought into conformity, receiving an appropriate price reduction or terminating the contract where the legal requirements for such remedies are met.

Nothing in these Terms excludes or restricts rights concerning digital services that cannot lawfully be excluded under applicable European Union or national law.

14. PRIVACY AND DATA PROTECTION

Personal data is processed in accordance with the PetAndHouseEU Privacy Policy and applicable data-protection legislation, including the General Data Protection Regulation (GDPR) where applicable.

Personal data processed through the Platform may include information provided during registration and use of the Platform, profile information, photographs, video introductions, voice and image contained in uploaded videos, listing information, communications, reviews, technical information and other data necessary to provide the Platform.

Members should review the Privacy Policy for detailed information concerning:

  • the categories of personal data processed;

  • the purposes and legal bases of processing;

  • storage and retention periods;

  • recipients and service providers;

  • international data transfers where applicable;

  • cookies and similar technologies;

  • marketing communications;

  • Member rights under applicable data-protection law; and

  • procedures for requesting access, correction or deletion of personal data.

15. INTELLECTUAL PROPERTY

The PetAndHouseEU name, branding, software, interface, design and Platform content owned by PetAndHouseEU are protected by applicable intellectual-property laws.

Except as permitted by law or expressly authorised by PetAndHouseEU, Members may not reproduce, distribute, commercially exploit or create derivative works from protected PetAndHouseEU materials.

Nothing in this section transfers ownership of Member Content to PetAndHouseEU.

16. MEMBER RESPONSIBILITY AND RISK

Members are responsible for deciding whether another Member and a proposed sitting arrangement are appropriate for them.

Members should communicate directly before agreeing to a sitting and exchange sufficient information to make an informed decision.

Sitting arrangements may involve risks including:

  • illness or injury involving pets;

  • property damage;

  • theft or loss;

  • travel disruption;

  • cancellation by another Member;

  • disagreements concerning pet care or property requirements; and

  • incompatibility between Members.

Members accept the ordinary risks associated with entering into private sitting arrangements with other Members.

17. LIMITATION OF LIABILITY

17.1. Platform Role

PetAndHouseEU provides the technological platform through which Members can find and communicate with each other.

PetAndHouseEU is not responsible for independently performing the private sitting arrangement agreed between Members.

17.2. Member Conduct

To the maximum extent permitted by applicable law, PetAndHouseEU is not responsible for losses caused solely by the acts or omissions of another Member, including:

  • cancellation or abandonment of a sitting;

  • damage caused by a Member;

  • theft by a Member;

  • inaccurate information supplied by a Member;

  • additional travel or accommodation expenses resulting from another Member's conduct; or

  • disputes concerning a private sitting arrangement.

17.3. No Guaranteed Match

PetAndHouseEU does not guarantee:

  • that a Member will receive applications or responses;

  • that a suitable Sitter or Owner will be available;

  • that a sitting will be arranged;

  • that another Member will perform a sitting as expected; or

  • any particular financial, travel or other result from membership.

17.4. Mandatory Liability

Nothing in these Terms excludes or limits liability where doing so would be prohibited by applicable law.

Nothing in these Terms limits mandatory statutory consumer rights.

Any limitation or exclusion of liability contained in these Terms applies only to the maximum extent permitted by applicable law.

18. EMERGENCIES AND MEMBER DISPUTES

PetAndHouseEU is not an emergency service.

Members should contact appropriate local emergency services, veterinary professionals, law-enforcement authorities or other relevant professionals where an emergency requires immediate assistance.

PetAndHouseEU does not guarantee that it can provide an alternative Sitter, alternative accommodation or immediate replacement arrangement where a sitting is cancelled or interrupted.

Members are primarily responsible for resolving ordinary disagreements arising from their private sitting arrangements.

This does not prevent a Member from contacting PetAndHouseEU regarding alleged breaches of these Terms or exercising any legal rights available to them.

19. INDEMNIFICATION

To the extent permitted by applicable law, Members may be responsible for losses, liabilities or reasonable costs suffered by PetAndHouseEU as a direct result of the Member's unlawful conduct, material breach of these Terms or infringement of third-party rights.

This provision does not apply where such liability would be unfair, disproportionate or prohibited under mandatory consumer-protection law.

20. CHANGES TO THESE TERMS

PetAndHouseEU may amend these Terms where reasonably necessary, including because of:

  • changes in applicable law;

  • regulatory requirements;

  • security requirements;

  • introduction or modification of Platform functionality; or

  • reasonable changes to the operation of the service.

Material changes affecting existing paid memberships will be communicated where required by applicable law.

Changes will not retrospectively remove mandatory rights already acquired by consumers.

21. GOVERNING LAW AND CONSUMER RIGHTS

These Terms are governed by the laws of Hungary and applicable European Union law.

If a Member is a consumer residing in another EU or EEA country, this choice of law does not deprive that Member of mandatory consumer protections available under the laws applicable to their country of residence where those protections cannot lawfully be excluded.

Nothing in these Terms prevents a consumer from bringing proceedings before a court available to them under applicable mandatory consumer law and jurisdiction rules.

22. SEVERABILITY

If any provision of these Terms is found to be invalid, unlawful or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.

Where possible, an invalid provision should be interpreted or limited only to the extent necessary to make it lawful and enforceable.

By creating an account, purchasing a membership or using PetAndHouseEU, the Member acknowledges having had the opportunity to read these Terms and agrees to be bound by them, subject to any mandatory rights available under applicable law.
